OnDeck - Terms of Service

1. Acceptance of Terms

OnDeck is a web application provided by ChasingTowers LLC ("we", "us"). By accessing or using OnDeck, you agree to these Terms of Service. If you do not agree, do not use the app.

2. Description of Service

OnDeck lets a host start a music party that guests join from their own devices to add songs to a shared queue and vote on them. Music is played through the host's connected Spotify account or, as a fallback, through YouTube. OnDeck does not host, store, or stream any music files itself; all playback occurs through these third-party services.

3. Eligibility

You must be at least 13 years old to use OnDeck. By using the app you represent that you meet this requirement.

4. Accounts and Sign-In

Hosting a party requires signing in with a Google account. The default Free mode plays through YouTube and needs no music subscription. If you choose native Spotify playback you connect a Spotify account, which requires a Spotify Premium subscription that you are responsible for maintaining. Guests may join with a display name or a Google account. You are responsible for activity that occurs under your account.

5. Third-Party Services

OnDeck integrates with Spotify, YouTube, and Google services. Your use of those features is also subject to the respective terms of service and policies of Spotify, YouTube/Google, and Google Cloud. You agree to comply with those terms. OnDeck is not affiliated with, endorsed by, or sponsored by Spotify, Google, or YouTube.

6. Acceptable Use

You agree not to use OnDeck to: submit or promote unlawful, infringing, or abusive content; harass other participants; attempt to disrupt, reverse-engineer, or gain unauthorized access to the service; or circumvent the usage limits or terms of any integrated third-party service. The host of a party is responsible for moderating its content and may remove songs or participants.

7. User Submissions

Songs you add to a queue are references to tracks available on third-party services; you do not upload audio. You are responsible for the song selections you submit and any name you choose to display. Within a party, your display name, submissions, and vote totals are visible to other participants.

8. Intellectual Property

All music, artwork, and metadata accessed through OnDeck remain the property of their respective rights holders and the third-party services that provide them. The OnDeck name, app, and original code are the property of ChasingTowers LLC.

9. Disclaimer of Warranties

OnDeck is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that any particular song will be available or playable, as catalog availability and playback are controlled by third-party services.

10. Limitation of Liability

To the maximum extent permitted by law, ChasingTowers LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of OnDeck, including any issues arising from third-party services such as Spotify, YouTube, or Google.

11. Termination

We may suspend or terminate access to OnDeck at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the service or other users.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of OnDeck after changes take effect constitutes acceptance of the revised Terms. Material changes will be reflected by the "Last updated" date above.

13. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law principles.
